Rugby Football Union drafts plan to risk-assess some transgender women players

Quote "The RFU has considered alternatives as part of its review, including both more and less restrictive measures, but having considered such alternatives, believes the criteria proposed in the policy are the most appropriate for domestic rugby union in England at this time."

Measures included in the draft policy include:

  • Transgender women players over 90kg (14st 2lb) or taller than 170cm (5ft 7in) may be assessed by an RFU coach or staff in a training environment to check if they have "a material performance advantage" or pose "a safety risk to other participants which is above the level presented by cis women players [players whose gender matches their assigned sex at birth]". The weight and height thresholds are based on "90% of cisgender women in the UK being below those measurements".
  • Transgender women will also be asked to provide details on their previous sporting background.
  • Transgender male players will be asked to sign a declaration that they understand the risks of playing men's or boys' contact rugby.
  • Non-binary players may participate in the gender category they feel most comfortable with, but must meet the same conditions as transgender players if that is different from their assigned sex at birth.
The RFU is inviting consultation on the proposed changes, and says it will "continue to monitor relevant new research and data" into the issue.

I believe the RFU are acting to pre-empt any legal action that someone somewhere may be willing/preparing to take.

Antoinette Harris, the first female outfield (Free Safety = defensive back) player ever to receive a full ride scholarship to an NAIA affiliated college. There have been several female kickers.


As the only female outfield player Toni Harris played High School (U19) football against boys, there's video of her taking down players twice her weight. Offered a scholarship in 2019, I can find no record of her playing any games at NAIA level during 2020. 

There are no concessions in high school/college football, females play against males on merit.

If you read the sugggestions they are saying if a born female player wants to change sex and play male rugby then no worries they do so at their own risk.

But if your 20yo 100kg 6' 2" no8 who played county colts decides to change sex they should not be allowed to play female rugby without a risk assesment first which is surely more sensible and less open to challenge than either an outright ban or acceptance

Insurance.

And you can't just tell someone they can't play without a reason, which needs to be testable up to court so you're covered. 

Basically, any organisation which doesn't have a policy for this, even if it only affects 2 people in a decade, is riding a dangerous horse. 

Even the freemasons have worked out and published a policy on how to deal with transgender issues. Why? Because like the RFU they don't want to just sit there and wait to get bitten.

RFL and RFU ban transgender women from competing in female-only forms of their games

The Rugby Football League (RFL) and Rugby Football Union (RFU) have banned transgender women from competing in female-only forms of their games.

The RFL's board approved its new policy which will come into effect in August.

The RFU's council voted on Friday to pass its new policy for the 2022-23 season, with "33 in favour, 26 against and two abstaining".

About 30 protestors gathered at the RFU's headquarters at Twickenham Stadium before the vote.

The RFL's new "Gender Participation Policy" applies to contact rugby league from Under-12s and above, while the RFU's guidance kicks-in for Under-12s and above.

There are currently six transgender women playing senior rugby union.

What has the RFU said?

The RFU, the governing body of the union code in England, had previously recommended a ban.

On Friday, the council passed policy which will "only permit players in the female category if the sex originally recorded at birth is female".

"The RFU Council has determined that until such time as new further peer-reviewed science is available, a precautionary approach is appropriate to ensure fair competition and safety of all competitors," a statement said.

This follows World Rugby's stance - which in 2020 became the first international sports federation to say transgender women cannot compete at the elite and international level of the women's game.

A group of protestors were at Twickenham on Friday to share their support for the trans community before the vote.

The RFU began a two-year review into its current policy in autumn 2020, which included a game-wide survey that received over 11,000 responses, considered scientific evidence and sought guidance from other sporting bodies.

"This science provides the basis of the new gender participation policy that concludes the inclusion of trans people originally recorded male at birth in female contact rugby cannot be balanced against considerations of safety and fairness," the RFU said.

It added that is had been "a complex and difficult decision and the policy change was not taken lightly or without thorough and full research and consultation".

RFU president Jeff Blackett said: "We know that many will be disappointed by this decision, however it has been based on all the scientific evidence available.

"Our game can be strengthened by everyone who is involved; be it in coaching, refereeing, administration or supporting and playing non-contact forms of the game."

The RFU said there were discussions of evaluating a case-by-case system but said: "In light of the research findings and work of World Rugby and the UK Sports Councils, and given the difficulties in identifying a credible test to assess physiological variables, this is no longer a viable option at this time and does not necessarily ensure inclusion."

The RFU added: "In the male category, players whose sex recorded at birth is female may play if they provide their written consent and a risk assessment is carried out."

The governing body has also contacted the transgender women players who are registered to play in England "to offer its support in continuing to encourage them to participate in the sport".

The RFU also said it will be conducting more research: "RFU is committed to working with World Rugby and UK Sports Councils to ensure further research is conducted and to reviewing the policy on a regular basis."

RFU faces legal action over transgender women ban

The Rugby Football Union (RFU) faces legal action against its ban on transgender women playing female contact rugby in England.

In July, the governing body's council voted to "only permit players in the female category if the sex originally recorded at birth is female".

Transgender player Julie Curtiss has mounted a legal challenge against the decision, the Daily Telegraph reported.

The RFU says it will "robustly defend" the case.

The Telegraph said that Curtiss has issued the RFU with a pre-action protocol letter, a legal document written to resolve a dispute before court proceedings start.

She says the policy discriminates against her under section seven of the Equality Act 2010.

I think we should define when it is ok for transgender patients to play - if prior to puberty the person transitions I feel in that situation they should be allowed to play. Anatomically they will likely be no different to female at birth players.
